General Reservation Policy

These terms and conditions only apply to bookings processed via www.hotelpuchet.com website (henceforth “Website”) and represents a contract between You (henceforth “Client”) and the Hotel Puchet Ibiza. enlace

This “Website” is property of PUTXET DE PONENT S.L. (henceforth “Hotel Puchet Ibiza”) with registered address as Carrer de Navarra, 7, 07800 Eivissa – ILLES BALEARS. NIF: CIF: B07320559

The request and processing of a booking via this “Website” implies the acceptance of the legal notice, the terms of use, the privacy policy, any outlined policy, all the conditions, all the rates and these terms and conditions, on the part of the “Client.”

Hotel Puchet Ibiza reserves the right to change, modify, add to or remove from these terms and conditions at any stage.

Applicable law

These terms and conditions are subject to the provisions set forth in Law 7/1998, of 13 April, regarding the General Contracting Conditions, the Royal Legislative Decree 1/2007 of 16 November, which approves the revised text of the General Law for the Defence of Consumers and Users and other complementary laws, Law 34/2002, of 11 July, regarding Information Society Services and E-Commerce, as well as all applicable tourism regulations and, alternatively, the Civil Code and the Commercial Code.

Clauses

Any booking made via this “Website” is subject to the following clauses:

Declarations

The “Client” states and declares:

• To be of legal age and possess full capacity to complete the booking, declaring that he or she understands, comprehends and accepts the totality of the conditions he/she finds outlined in this “Website.”
• That the data provided when completing the booking are true and complete.
• That he/she confirms the requested booking, in particular the indicated dates, the number of people and the type of room.
• That he/she accepts the terms and conditions, as well as the cancellation policy associated with the contracted rate (rate stipulated in the “Website” at the time of making the booking)
• That he/she accepts the total amount of the booking payment described, always in Euros.

Children

Children of all ages are welcome in the complex.

Baby cots for minors between 0 and 2 years are free, but you must specify requirement thereof at the time of booking.

A 50% discount is applied to lodgings and boardings for children between 3 and 12 years when they are staying in the same room as 2 adults.

Minors over the age of 13 are considered adults with regards to lodging and boarding meals.

Lodging for under 18s

Hotel Puchet Ibiza does not make bookings for minors under the age of 18.

Situation in which under 18s may stay at Hotel Puchet Ibiza:

• With their legal guardian (parent(s) and/or guardian(s))

Exceptional cases:

• Accompanied by a person over 18
• In groups, accompanied by one and/or various people over the age of 18

Accessing the Website

Accessing this “Website” is the responsibility of the “Client”.

Reservations

The booking includes the services outlined according to the conditions of the rate stipulated on the “Website”. These particular conditions (contracted rate) together with these general terms and conditions must be accepted by “You” before completing the booking. The contract can be completed in Spanish or English. In the case of discrepancies between the translated version of these conditions, the Spanish version will prevail.

Non-Refundable Rate
The non-refundable rate does not permit modifications.
Advance payment: The total amount shall be charged to the client’s card when the booking is complete.
Cancellation with fees: If a non-refundable booking is cancelled, if the client does not show up at the hotel on the day of arrival or in the case of early check-out, the paid amount will not be refunded.

Standard rate
The client will be requested to pay for the first night to guarantee the booking. The client may pay for the remainder of the stay upon arrival at the hotel.
Cancellation without fees: The client may cancel his/her standard rate booking up to 72 hours before the date of arrival.
Cancellation with fees: If the client cancels the standard rate booking within 72 hours or less of the date of arrival or if he/she does not show up at the hotel on the day of arrival, he/she will be billed for the first night as a form of cancellation fee. In the case of early or unexpected check-out, he/she will be charged for the entire stay.

Online bookings via this “Website”: The completion process follows the following steps:

STEP 1. Selection of dates and rooms.

STEP 2. Selection of extras. Booking summary.

STEP 3. Personal details and payment of booking. Booking conditions.

STEP 4. Booking confirmation.

Once the booking has been completed, a confirmation email will be sent to the contact address provided by the “Client” (henceforth “Confirmation Slip”).

The booking is considered accepted when: payment has been completed and the “Confirmation Slip” has been received.

Provided that the contracted rate permits it and that there is availability, the “Client” has the option of modifying the booking by means of the “My Booking” option, which he/she has received in the “Confirmation Slip”.

Hotel Puchet Ibiza offers packages or extras which the “Client” may purchase in the process of completing the booking.

Any special request (special refers to anything which does not appear outlined in any step of the booking process) must be discussed and/or requested in advance during the booking process, specifically in the “Observations or Requests” section or can also be dealt with at the Hotel Puchet Ibiza Reception, and always according to availability.

Check-in: Unless otherwise stated in the rate conditions, check-in is from 15:00 on the anticipated day of arrival and check-out is at 11:00 at the latest on the day of departure.

In the case of a failure to arrive (No-Show), the amount of the contracted rate stipulated in the terms and conditions will be charged.

In the case of early or unexpected check-out, he/she will be charged for the entire stay.

Price and payment

The price of services and accepted payment methods are those that are expressly determined on this “Website,” and will be expressly defined in the booking process.

Payment for services will be completed by means of credit card. Hotel Puchet Ibiza does not store your card details. Payment is completed via a virtual payment gateway.

Hotel Puchet Ibiza has implemented a policy on the mismatch of the holder of the booking and of the credit card for payment: In the case of not being the holder of the credit card used to complete the reservation, contact must be made in advance with Hotel Puchet Ibiza’s booking department, info@smturistic.com and a form to be filled out must be requested. Otherwise, payment will be cancelled and must be completed directly at Hotel Puchet Ibiza before checking in.

Promotions and offers will only be valid during the time they remain accessible. These will have specific Terms and Conditions.

Unless otherwise stated, prices indicated on the Website are the prices for sale to the public (retail price), VAT inclusive. The transaction will be completed in EUROS, regardless of the origin of the Client. Any other fees, taxes or supplements that may be accrued as a consequence of lodging, such as the tourist tax (per person and night), will be paid directly at the establishment during the check-in process.

Booking cancellations

Booking cancellation is outlined in the terms and conditions of the contracted rate.

Exception: in the case of a State of Alarm or closure of borders, whether in the country of origin or in the Spanish State, cancellations or modifications may be made to the booking as long as the booking has been made through this “Website” and prior to the situations described. The method of completing said cancellation or modification will be by sending an email to, info@smturistic.com , detailing the situation, and obligatorily attaching the “Confirmation Slip”.

If the “Client” wishes to make a cancellation and the rate allows it, the refund will be after a period of 30 days from the cancellation request.

If the “Client” wishes to make a modification and the rate allows it, he/she will be given the option to change the dates, and these must fall within 365 days following the modification request. Alternatively, the following season, if the accommodation is not open year round.

Any failure by the Client to comply with any of the conditions set forth in this policy will result in:
The automatic cancellation of the booking made on this website upon the Client´s arrival at the Hotel.
The Client being required to pay one night as a penalty, as this is regarded as a serious event and due to the loss this entails for the Hotel.
The Client, if he/she wishes to stay at the Hotel, and subject to availability, will be required to make a new booking in accordance with the conditions and prices in force at that time.

Right of withdrawal

Under the terms provided for in article 97.1 i) Royal Legislative Decree 1/2007, it is informed that, pursuant to article 103 I) of the aforementioned Royal Decree Act, the right of withdrawal may not be exercised.

Nullity of clauses

If one or more of the clauses included in these general conditions (terms and conditions) were to be, in whole or in part, declared null and void or unenforceable, this shall only affect said provision or that part thereof that has been declared so, with the general conditions surviving in all other respect, said provision, or the affected part thereof, shall be treated as if it had never existed.

Acceptance

The request and completion of the booking necessarily implies that each and every one of these general conditions (terms and conditions), considered to be an integral part of the booking and complemented with the rate conditions and the specific applicable legislation, are expressly accepted by the “Client”. 

Applicable law and place of jurisdiction

This contract shall be governed by Spanish law without regard to its conflict of laws. Without prejudice to the recognised rights of consumers in terms of the jurisdiction by the Royal Decree Legislation 1/2007 of 16 November, any controversy that may result from using the Website or the services associated therewith shall be subject to the jurisdiction and competence of the jurisdictional Court and Tribunals of Ibiza, with the “Client” expressly waiving any other jurisdiction which may correspond to them.
